Prepare Your Will and Estate

Having a properly prepared will and estate plan protects your family and property in the case of an emergency by legally determining what happens to your assets. Keeping an up-to-date will is important, especially if you are going through a divorce or separation. I will work with you to make sure that your new will and estate plan reflect your current wishes, and that the proper beneficiaries are noted.


Powers of Attorney

A power of attorney is a legal document granting someone else the right to act on your behalf. The term “attorney” in this instance refers to the person or persons named in the contract—they do not have to be a lawyer. In Ontario there are three kinds of power of attorney agreements:


  • A Continuing Power of Attorney for Property – This covers your financial affairs and allows the person named to act for you even if you become mentally incapable
  • A Non-Continuing Power of Attorney for Property – This also covers your financial affairs, but cannot be used if you become mentally incapable. This is ideal for having someone take care of your financial transactions while you are away from home for an extended period of time
  • A Power of Attorney for Personal Care – This covers your personal decisions, such as housing and health care


While the person named in the contract does not have to be a lawyer, it is wise to consider hiring a lawyer to at least review the document. This helps to ensure that all relevant items are addressed to avoid any complications down the road.
